FLORIDA SUPREME COURT AFFIRMS UPL DECISION

The Florida Supreme Court has affirmed their January 15, 2015 Advisory Opinion on Non-Attorney Medicaid Planners and the Unlicensed Practice of Law. The opinion basically explains activities which had previouly been done by non-attorneys, as constituting the  practice of law and therefore prohibited, unless done by a licensed attorney. Since the unlicensed practice of law is a felony, it is considered a very serious matter by the Florida Bar, Supreme Court and State Attorneys Office. The Elder Law Center of Mondschein and Mondschein, P.A. will be explaining the opinion to nursing homes, assisted living facilities, hospital discharge planners and clients so that they will understnad the law and know how to report a violation to the proper authorities.
