How Do I Resign From a Power of Attorney?

Simply send a letter to the person who appointed you. I’m assuming they are still alive. If they have passed away and the will has been admitted to probate, you will have to seek court approval of your resignation. If after the person passes away you are still named in their will and you do not want to take on this role, you can file a declination with the probate court at that time.
