I was honored to be one of the speakers at a recent workshop sponsored by the Wisconsin chapter of the National Academy of Elder Law Attorneys, held in Wisconsin Dells. The three topics I spoke on were: Successfully arguing undue hardship, in the event of either a Medicaid denial, or a claim of Estate Recovery against a decedent’s estate; The current problems of over verification from the county Medicaid agencies (the process where they demand far more records and documents than is necessary or required by law); and the process for submitting an open records request when dealing with the county/state Medicaid agencies.
Unfortunately, all of these issues are becoming more problematic when dealing with the State. The program was well attended by attorneys from across the state.
