"The Ambiguities of a Living Will"


On October 11thbeginning at 11:00 a.m., Mr. Di Costanzo will be lecturing for the Hudson Valley Chapter of the Alzheimer's Association on legal and financial matters.  The program is a lunch and learn supported in part by the NYS Department of Health and will be held at the Mahopac Public Library located at 668 Route 6, Mahopac, New York.  This lecture is open to the public.

On October 12thMr. Di Costanzo will be lecturing for the Katonah Women's Club on elder law and estate planning matters.  The program will be held at Memorial Building located at 71 Bedford Road, Katonah, New York.  This lecture is closed to the public.

On October 15thMr. Di Costanzo will be sponsoring the 2017 Walk to End Alzheimer's taking place at Veterans Memorial Park, 201 Gypsy Trail Road, Carmel, New York.  Click here to register or donate.

On October 17th, Mr. Di Costanzo will be lecturing at Senior Law Day sponsored by the Westchester County Office of the Aging being held at the Westchester County Center.  His lecture begins at 11:00 and is on "Legal and Financial Planing for the Newly Diagnosed Dementia Patient". This lecture is open to the public.  Mr. Di Costanzo and Ms. Feldman will also be providing free consultatations at the event throughout the day.

On October 24th, Mr. Di Costanzo and Ms. Feldman will be continuing their informal educational series on elder law and estate planning matters.  The theme for this session will be "Cider and Donuts".  Each event is structured as a Q & A event, held in the relaxed parlor setting of our Yorktown Heights office from 6:00 p.m to 7:30 p.m.  Please contact Melanie at 914-925-1010 to R.S.V.P.  This event is open to the public but you must R.S.V.P. and seats are limited.

Does My Dad Need a Power of Attorney If I Can Pay His Bills With a Joint Bank Account?

My dad had a stroke, which has led to aphasia and mild dementia. He can't communicate the right words but he seems to be able to understand, although he forgets things. Before his stroke, he put me on his bank account to manage paying his bills. I am also the beneficiary on his life insurance and annuities. Do I still need to have him sign a power of attorney or something?

Can the State Make a Claim on My Father's House if He Is Receiving Medicaid Home Care?

I just applied for Medicaid for my mom and dad to receive home care. I don't think either of them will move into a nursing home because they have friends and family nearby. My mom is confined to a wheelchair and needs daily assistance with eating and bathing. My dad will be starting dialysis soon. My question is, will Medicaid attach itself to my parents' home if they are receiving home aid? Currently the deed is only in my dad’s name.
