The law firm of Enea, Scanlan & Sirignano, LLP is pleased to announce that six of our attorneys have been selected for inclusion in the 2025 New York Metro edition of Super Lawyers. 2025 marks the nineteenth consecutive year Anthony J. Enea has been included in the Super Lawyers list, and the thirteenth time he has been honored as a “Top 25” attorney in Westchester County. Should I Open a 529 Plan or a Trust for My Children and/or Grandchildren?

Before addressing 529 Plans and/or trusts for education and related savings, let me begin by saying I am reluctant to recommend an UTMA (Uniform Transfer to Minors Act) account as a means for saving for the education of a child and/or grandchild, the sole reason being that, upon attaining the age of 21 in New York, the 21-year-old can withdraw the money from the account. It becomes their money to do as they please.
529 Plans, on the other hand, provide more structure. They have a number of positive virtues as well as detractors. Section 529 of the Internal Revenue Code (IRC) governs the creation of these tax-deferred savings plans, which are designed to help finance the ever-increasing costs of higher education. 529 Plans are available in all 50 states and in the District of Columbia. They come in two basic varieties: a pre-paid tuition plan (less popular) and the 529 College Savings Plan. For purposes of this article, we will focus on the 529 College Saving Plans.

Is Your POA Up to Par?

When it comes to estate planning, the focus is often on the Last Will and Testament. Yet, one could easily argue the Power of Attorney (POA) is just as important. A POA is a legal document that you (the “principal”) execute during your lifetime, while you have mental capacity, designating another person (your “agent”) to handle your financial affairs if there comes a time when you are unable to do so yourself. Yet, not all POAs are created equal… If you become ill or suffer a tragic accident and your POA doesn’t cut the muster, your agent will not be able to take necessary actions on your behalf, and a Guardianship proceeding in the Supreme Court of the County where you are physically located becomes the only option. How do you know if your POA is sufficient?
First, make sure your POA is not a “springing” power of attorney, meaning that your agent is authorized to act only after a specific event or condition occurs—this can be problematic as it may be subject to interpretation. Your POA should be effective the moment you (and your agent) sign it.
