- Illinois and Online Wills -

Illinois has joined a growing number of states that now allow individuals to create and execute Wills online.  On July 26, 2021, Governor Pritzker signed the Electronic Wills and Remote Witnesses Act, which took effect immediately.  Recent Illinois legislation passed and signed by the Governor also amended the Illinois Notary Act to provide for remote/online notarizations. That Public Act, however, will not take effect until the later of either of the following:  the promulgation of the new administrative rules by the Secretary of State or January 1, 2022. This means that while Illinois residents now have the option of creating an electronic Will, adding a remotely (online) notarized "attestation" clause Illinois is not yet possible.  Thus, stay tuned for additional updates as to remote notarization status and when our office will begin offering electronic Wills.
